Danny's Penguin was absolutely better and worked better for the movie as a whole (even if less believable). As a consequence, Danny Devito eating raw fishheads lives rent-free in our nightmares. Colin's Penguin does a better job of making a wacky Batman villain actually seem plausible which is a feat on its own.

Penguin is one of those characters who easily falls into the generic ”crimininal with a theme” trope that Batman is famous for. Ive read some of the earlier treatments of the script and it was close to going in that direction. But the creative team, Hamm, Burton, DeVito, Neil, everyone, they made this take something special. Unforgettable.
